United States Supreme Court

The United States Supreme Court is the highest court in the nation. The Supreme Court only reviews a small number of selected cases each term but its decisions affect hundreds more since the lower courts rely on the Supreme Court decision to help them determine how the law applies to different situations.

Below we have summarized some recent American with Disabilities Act decisions and provide links to the decisions.

State Liability

Did Congress have the authority to enact Title II of the Americans with Disabilities Act, which allows people with disabilities to sue states for money damages if the state discriminates against them in the provision of services and programs? The Supreme Court said "yes" in Tennessee v. Lane, a case regarding two individuals with disabilities who were denied access to a state courthouse.

Definition of Disability

Should mitigating measures, such as medicines and changes in daily schedules, used to treat a health impairment be considered in deciding whether someone is disabled under the American with Disabilities Act? The court said "yes" in Sutton v. United Airlines et al.

When does a physical impairment substantially limit a major life activity? The court looks at this issue in Toyota v. Williams.

Mandatory Arbitration

Can the EEOC sue an employer for discrimination and seek monetary damages for an individual employee, even if the employee agreed to submit all discrimination claims to binding arbitration? The court said "yes" in EEOC v. Waffle House.

Other Recent Supreme Court Decisions

Can an employer fire you if he thinks you will hurt yourself on the job because of your epilepsy? The Supreme Court answered this question with a resounding "yes" in Chevron Oil, Inc. v. Echazabal.
