Sample Language for your Will

For an Outright Bequest of a Specific Dollar Amount

“I hereby give, devise, and bequeath the sum of $_____ to the Epilepsy Foundation of Western Ohio, a tax exempt organization currently located at 7523 Brandt Pike, Huber Heights, OH 45424. This is an unrestricted gift and may be used at the discretion of its Board of Trustees to further the objectives and purposes of the Epilepsy Foundation of Western Ohio.”

For an Outright Bequest of a Share, or Entire Residue, of Your Estate

“I hereby give, devise, and bequeath ___% of my residuary estate to the Epilepsy Foundation of Western Ohio, a tax exempt organization currently located at 7523 Brandt Pike, Huber Heights, OH 45424. This is an unrestricted gift and may be used at the discretion of its Board of Trustees to further the objectives and purposes of the Epilepsy Foundation of Western Ohio.”

Bequest to EFWO for a Specific Purpose or Program

Please contact us at EFWO first to discuss the purpose or program you wish to designate so that we are best able to honor your wishes. Following is sample language for bequeathing a specific amount of money or a percentage of your residuary estate for a particular purpose or program.

“I hereby give, devise, and bequeath the sum of $____ [or ___% of my residuary estate] to the Epilepsy Foundation of Western Ohio, a tax exempt organization currently located at 7523 Brandt Pike, Huber Heights, OH 45424 for the following use and purpose: [insert description of purpose].

It is my preference that the gift remains used for the specified purpose.  However, I understand and agree that if, at some future time, it is no longer practicable in the judgment of the EFWO Board of Trustees to use the gift for the purpose intended, the Trustees shall have the right to use the gift for whatever purpose they deem necessary and reasonable in accord with the intent described herein.

Conditional Bequests

For a conditional bequest, insert the conditional language in one or more of the above paragraphs. For example:

“If my husband/wife/partner does not survive me, I bequeath the sum of $_____ [or ___% of my residuary estate] to the Epilepsy Foundation of Western Ohio, a tax exempt organization currently located at 7523 Brandt Pike, Huber Heights, OH 45424. This is an unrestricted gift and may be used at the discretion of its Board of Trustees to further the objectives and purposes of the Epilepsy Foundation of Western Ohio.”

If you intend for your conditional bequest to be used for a specific purpose or program, please contact EFWO to be sure that we will be able to honor your wishes. This is sample language for conditional bequests for a specific purpose or program:

General Memorial Fund

I give, devise, and bequeath to the Epilepsy Foundation of Western Ohio, a tax exempt organization currently located at 7523 Brandt Pike, Huber Heights, OH 45424, the sum of $ ___ (real or personal property herein described), to be known as the ______________________ Memorial Fund.  The Board of Trustees of the Epilepsy Foundation of Western Ohio, at its discretion, shall determine the use of the income from this fund for any purpose of the Foundation.  The said Board of Trustees may authorize the expenditure of all or any part of the principal of the fund for some project or special purpose that will forward their work of assisting individuals who have epilepsy/seizure disorders.
